Dr. Arif ErençinAralık 2005, 111 SayfaYönetimin coğrafi ve işlevsel olarak genişlemesine koşut olarak yenidenetim türleri ortaya çıkmaktadır. Bu gelişmenin sonuçlarından birisi de halkdenetçiliği kurumunun oluşturulması ve yaygınlaştırılmasıdır. Bu kurum, diğerdenetim mekanizmalarının alternatifi değil, onların eksikliklerini gideren,boşluklarını dolduran bir kurum olarak görülmektedir. Halk denetçisi, yargı organıkadar bağımsız fakat ondan daha az biçimci, daha hızlı çalışan, yönetimin içinekolaylıkla girebilen, söz konusu yönetsel olayla ilgili olarak daha somut ve kişiselaraştırma yapabilen bir kurumdur. Bu kurum yönetimi sadece yasallık çerçevesindedeğil, insan hakları bakımından da denetler ve değerlendirir. Yönetimin işlemeyenve eksik yanlarını, kusurlarını ortaya çıkarır ve eleştirir. Bazı ülkelerde ulusal halkdenetçisinin yanında, yerel düzeyde yetkili yerel yönetimler halk denetçisioluşturulmuştur. Türkiye de bu gelişmelerin etkisi altındadır. Cumhurbaşkanıtarafından TBMM'ne geri gönderilen ve henüz yasalaşmamış bulunan ?KamuYönetiminin Temel lkeleri ve Yeniden Yapılandırılması Hakkında Kanun?(KYTK)'un 42. maddesinde ?mahalli idareler halk denetçisi?ne yer verilmiştir. Buçalışmada, yönetimin denetlenmesi bağlamında, oluşturulması hedeflenen yerelyönetimler halk denetçiliğinin, farklı ülkelerde ortaya çıkan uygulama örnekleriçerçevesinde değerlendirilmesi yapılarak varılan sonuçlar ve öneriler ortayakonulmuştur.Anahtar Kelimeler : Denetim, yerel yönetim, halk denetçisi, yeniden yapılanma. | en_US |

Dr. Arif ErençinDecember 2005, 111 pagesNew ways of control are invented due to the geographically andfunctionally enlargement of administration. The establishment and extension of theinstutition of Ombudsman is one of the results of this development. This institutionisn?t an alternative for other control mechanisms, but it seems as a contributer toovercome inadequancies of control. Ombudsman is an institution as independent asa judge, less formalist, working faster, who enters the management easily, whoconducts concrete and personal investigation on exercise of administrative functions. This institution controls and evaluates administration not only in the perspective oflegality but also according to human rights. It exposes and criticizes the limping andfaulty dimensions of administration. Some countries established local ombudsmanbesides national. Turkey observes the impacts of this development. More recently,?The Law on Basic Principles and Reforming Public Administration? which is sentback to the TGNA for further debate by the President and not still ratified, containslocal government ombudsman in article 42. In this study, in the context of control ofadministration and with comparing the implementation of local ombudsman indifferent countries, the results and suggestions on attempts to establish localgovernment ombudsman in Turkey is reviewed.Key Words: control, local government, ombudsman, reform. | en_US |
